GENERAL CONDITIONS OF SEA TRANSPORT IN SEA EXCURSION REGIME

These General Conditions of Maritime Transport are displayed and available to the public for consultation prior to booking and purchasing tickets, both in paper format, in all sales areas at the Carrier's official ticket offices, and in digital format, at the Company's website (https://www.attractioncatamarans.com/).
1.-DEFINITIONS

By "Carrier" is understood as such the Company MALLORCA SAILING CATAMARANS S.L. that carries out the transport of passengers under the maritime excursion regime with its ships, in any exploitation and/or management regime.
By "maritime excursion" is understood that passenger transport service associated with the realization of tourist trips in ships or boats that depart from a port and, after following an itinerary, return to the port of departure in a period of duration not exceeding 12 hours, being able to make anchorages and intermediate stopovers in another port but all passengers must complete the entire itinerary.
"Ship" means the ship used for navigation by sea or inland waterways, which is a passenger ship.
By "Passenger contract" is understood the transport contract between the carrier and a passenger for the provision of one or several passenger transport services under the maritime excursion regime.
By "Ticket" or "boarding pass" it is understood that document validly issued by the carrier as proof of the contract of carriage of the passenger entered into.


2.- APPLICABLE LAW AND LIABILITY REGIME

Spanish Law, community regulations and those International Agreements to which Spain is a party will apply to this passenger transport contract under the maritime excursion regime. Specifically, Law 14/2014, of July 24, on Maritime Navigation, which is considered incorporated into the passenger contract, shall apply to this transport contract.


3.- PASSAGE AND TICKET CONTRACT

Through the passage contract, documented by issuing the corresponding ticket and/or boarding pass, the carrier agrees, in exchange for a price, to transport the passenger by sea, and where appropriate, their luggage, under a maritime excursion regime. .
The ticket is personal and non-transferable and may be issued in electronic format. The maritime transport contract is perfected with the prior payment of the ticket duly issued by the carrier, it being understood that the passenger expressly accepts all its terms and conditions, for the mere fact of having used it as a transport title.
Only people with a ticket and/or boarding pass for the date, time and route indicated on both will board. The carrier is not responsible for the loss of the ticket/boarding pass. The passenger has the obligation to keep both documents throughout the journey. For any claim, the passenger must present a copy of the ticket and the boarding pass, otherwise the claim cannot be processed.
The carrier offers passenger transport subject to its general, promotional and/or special rates, duly published in all sales areas, at the official ticket offices and on the company's website. The carrier reserves the right to modify said rates without prior notice.
The carrier is not responsible for the passenger's handbags and belongings in case of theft or loss.
There are claim and suggestion sheets available to travelers at our departure and arrival points.


4. SCHEDULES, ROUTE, BOARDING, AND CANCELLATIONS

The departure times of each maritime excursion are predetermined and available to the public for consultation prior to reservation and purchase of tickets, both in paper format, in all sales areas at the Carrier's official ticket offices, and in digital format, on the Company's website (https://www.attractioncatamarans.com).
The carrier is empowered to modify the announced schedules and even suspend and cancel the transport for security, organizational, meteorological or force majeure reasons.
The carrier will determine and inform of the "cut-off time" for acceptance to boarding, after which passengers who are not ready to board will be denied boarding. The carrier declines any type of responsibility for the denial of boarding of those passengers who show up after the deadline for acceptance to boarding has passed.
The carrier will be free to carry out the transport following the route and itinerary that it deems most appropriate.
In case of cancellations by the passenger, the following conditions will apply:
-Cancellations produced with a minimum of 3 days prior to departure, have NO penalty.
-Cancellations produced with less than 3 days, 50% penalty of the cost of the excursion, for management expenses.
-Cancellations WITHOUT notice, loss of the total amount of the reservation.


5. DISCIPLINE ON BOARD

The captain holds the command and direction of the ship, will have the status of authority on board, and may take as many police measures as he deems necessary to maintain order on the ship, as well as to guarantee the safety of those who are on board. Passengers must abide by the captain's orders, without prejudice to their right to make the claims they deem appropriate once the ship arrives at port.


6. MAIN SERVICE, ACCESSORY SERVICES AND TAX REGIME

For the purposes of the provisions of Law 37/1992, of December 28, on Value Added Tax (VAT), VAT will be charged at a reduced tax rate of 10 percent because it is a maritime passenger transport activity ( Article 91.one.2.1 of Law 37/1992. Other accessory services on board, such as drinks on board, are taxed jointly with the main transport operation.


7. JURISDICTION:

Controversies that arise related to the interpretation, application or execution of the transport contract, will be submitted to the jurisdiction of the Commercial Courts of Palma de Mallorca, without prejudice to the right of the consumer to resort to the alternative resolution of disputes in matters of consumption.
